Terms of Use

The agreement between you and Antonite when you use this site. Plain English first; legal precision in parentheses where it matters.

Section 1

About this site

antonite-music.com is the website of Antonite, a Canadian solo music project. The site lets you listen to releases, read articles, comment, vote on what songs get made next, submit your own work to the Fan Gallery, and contribute to the music.

These Terms (the “agreement”) are a contract between you and the individual who operates Antonite. By using the site you accept them.

Section 2

Acceptance and eligibility

  • You must be at least 14 years old to create an account. If you're under the age of majority where you live, you confirm you have a parent or guardian's permission.
  • By creating an account, posting a comment, casting a vote, uploading a submission, or making a contribution, you accept these Terms.
  • If you don't accept them, don't use the site.

Section 3

Your account

  • Use a real email address. We use it to contact you about your account, your submissions, and your contributions.
  • Pick a display name that isn't impersonating anyone or clearly abusive. We can change or remove display names that violate this rule.
  • You're responsible for keeping your password secret. Tell us right away if you suspect someone else got access to your account.
  • One account per person. Don't share accounts.
  • You can delete your account at any time. See the Privacy Policy for what happens to your data when you do.

Section 4

What you can't do here

Be a decent person to other people on the site. Specifically, don't:

  • Harass, threaten, demean, or stalk anyone - other users, the artist, or third parties.
  • Post hate speech, sexual content involving minors, or content that incites violence.
  • Upload material that infringes someone else's copyright, trademark, privacy, or other rights.
  • Try to break, probe, scrape, or overwhelm the site, the audio streams, the database, the auth system, or the payment system.
  • Use the comments, submissions, or contact form for advertising or unsolicited promotion.
  • Impersonate Antonite, another user, or any third party.
  • Sell, transfer, or trade your account.
  • Submit AI-generated work as your own unless it's clearly labelled as such on the submission.
  • Anything else that breaks the law that applies to you.

We can remove content, suspend accounts, and refuse service for any breach of these rules.

Section 5

Content you post

You own it

You keep the rights to anything you post: comments, votes, lyrics, artwork, audio, photography, contact messages, anything else.

You give us a license to display it

By posting it on the site, you grant Antonite a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and (for fan submissions) adapt, modify, and create derivative works of your content for the purposes of operating the site, promoting Antonite's music, and (for submissions you opt to make available) using your work in releases.

This license lasts as long as your content is on the site, plus a short tail for backups and the small cases where we've already used it elsewhere (e.g. in a release whose artwork was a featured submission, or in a newsletter that's already gone out).

You take responsibility for it

You promise that you own or have permission to post everything you submit, that it doesn't infringe anyone else's rights, and that it complies with these Terms.

We can moderate it

We can hide, pin, edit, or remove content that breaks the rules, for any other reason at our discretion, or to comply with the law. Moderation decisions are final at our end - if you think we got it wrong, write us and we'll consider it, but we're not obligated to reverse it.

If someone copies your work

If you see content on the site that infringes your copyright, email privacy@antonite-music.com with the URL, a description of the work, and proof that you own it. We'll act in line with the Canadian Notice-and-Notice regime under the Copyright Act, and (for international claims) with the DMCA where applicable.

Section 6

The artist's work

The music, lyrics, articles, artwork, and design on this site are the intellectual property of Antonite (or licensed to Antonite) and protected by Canadian and international copyright law.

You may:

  • Stream and listen to the music here for your personal, non-commercial enjoyment.
  • Share links to pages on this site (including/music/[slug]pages) on social media or in private messages.
  • Quote a short excerpt of an article for review or commentary, with credit and a link back.

You may not:

  • Download, re-upload, redistribute, remix, sync, or sample the audio without written permission.
  • Republish article text or artwork without permission.
  • Use the Antonite name, logo, or wordmark for anything that implies endorsement.

Section 7

Contributions

You can support the music at/support - either directly (a general "help make more music" contribution) or toward a specific project. When you contribute:

  • Payments are processed by Stripe in Canadian dollars (CAD). Your card information goes directly to Stripe - we never see the number.
  • The amount you enter is the amount you're charged, immediately. There's no pre-authorization or staged billing.
  • A contribution is not a purchase of equity, securities, debt, royalty share, or a profit interest, and it is not a tax-deductible donation. It's a co-production contribution to help make the music, optionally rewarded with early access.
  • From time to time I give contributors early access to a release before public launch.
  • Contributing supports my music in general. There are no funding goals or deadlines, and nothing auto-completes on a target - the more support I get, the more time I can devote to writing and recording. Simply put: more support means more music.
  • Even a contribution toward a specific project supports its creation; it isn't a pre-order and doesn't guarantee a particular song or release date. Those who already tried writing a full song know it: sometimes, things don't go as well as we thought, and we end up with a song that seemed so great on paper, but it just doesn't sound right in the end.

Section 8

Refunds

Because contributions are voluntary support rather than a purchase, they aren't refundable as a rule. Still, I'm reasonable: if you contributed by mistake (the wrong amount, or a duplicate) or you simply regret it, reach out through the contact page and I'll review it personally and refund at my discretion. Any refund I approve goes back through Stripe to your original card, usually within 5-10 business days, depending on your bank.

Section 9

Suspension and termination

We can suspend, restrict, or close an account that breaches these Terms, that we reasonably suspect of fraud, or that the law requires us to close. Where the breach is minor and reversible, we'll usually warn first. Where it's serious, we'll act immediately.

You can close your account at any time. Closing doesn't cancel a completed contribution or reverse the early-access grant tied to it.

Section 10

No warranties

The site and everything on it is provided “as is” and “as available”. We don't guarantee it will be available without interruption, free of errors, secure against every possible threat, or fit for any particular purpose beyond the basic ones described. To the maximum extent permitted by law, we disclaim all implied warranties (including merchantability, fitness for a particular purpose, and non-infringement).

Section 11

Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the site or these Terms is limited to the greater of (a) the total amount you paid us through the site in the twelve months before the claim, or (b) one hundred Canadian dollars (CAD $100).

We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost goodwill, or lost data, even if we've been warned that they could occur.

Nothing in these Terms limits any right you have that can't legally be limited, including consumer-protection rights under Quebec or other applicable law.

Section 12

Governing law and disputes

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there, without regard to conflict-of-laws principles. The courts of Quebec have exclusive jurisdiction for any dispute arising out of these Terms or your use of the site, subject to any mandatory consumer-protection rules that grant you the right to sue in your own jurisdiction.

Section 13

Changes to these Terms

We may update these Terms when the site changes, when the law changes, or when we change how we operate. The “Last updated” date at the top tells you when. We email registered users about material changes at least thirty days before they take effect. Continuing to use the site after that point means you accept the updated version.
